Agency: Department of Commerce, National Processing Center Docket ID: NSPS-2005-001 RIN #: 3206-Ak76 Subpart G -- Adverse Actions Section 9901.712 Mandatory Removal Offenses Part (a) One person no matter what their position within DoD should have unreviewable discretion or authority to remove any employee without providing that employee with advance opportunity to declare and/or prove their innocence. This sections states that the Secretary has sole, exclusive, and unreviewable discretion to identify offenses that have a direct and substantial adverse impact on the Department's national security mission. Will there be any guidelines in place stating what these offenses might be or are these offense just deteremined by the Secretary whenever something presents itself?
