Agency: Department of Commerce, National Processing Center Docket ID: NSPS-2005-001 RIN #: 3206-Ak76 Subpart H -- Appeals Section 9901.803 Waivers DoD should never be allowed to waive the rights of any employee to participate in MSPB appeals. MSPB was established to protect employees from wrongful and frivalous adverse actions issued to an employee by an Agency. Pushing aside MSPB and allowing the Secretary to appoint members to a new National Security Labor Relations Board does not protect the rights of any employee within DoD. Having the NSLRB hearing appeals filed by employees is like having the fox watch the hen house. An employee could probably never win and appeal that was filed with this new board because they are all appointed by the Secretary and be biased to make any decisions against the Department.
