SUBPART H: APPEALS. Section 9901.803 - Waivers. In this section, DOD/OPM purport to supersede MSPB appellate procedures that are inconsistent with these regulations. DOD/OPM also purport to direct MSPB to follow these regulations until MSPB issues its own conforming regulations. Nothing in the Act or any other law gives DOD/OPM such authority over the MSPB. Accordingly, I recommend that this proposal be deleted from the regulations.
