Agency: Department of Commerce, National Processing Center Docket ID: NSPS-2005-001 RIN #: 3206-Ak76 Subpart I -- Labor-Management Relations Section 9901.902 Scope of Authority By law under 5 U.S.C. 7101-7135, the Department has requirements to negotiate with labor organizations those things that are not deemed exclusively management rights. The Department should never be able to remove employee rights which were so hardly fought for so many years ago. Many citizens fought and died for the right to have a labor organization represent there interests within companies. Now because the Secretary wants to portray DoD employees as threats to our National Security because they belong to a labor organization, he/she should be given the right at their sole, exclusive and unreviewable discretion preclude them from having this choice any longer. During the Gulf War in 1991, many DoD employees work along side our brothers and sisters of the Armed Forces to help and aide our fighting brothers and sisters in battle. At that point in time, you never heard any mention of these employees being a threat to America's national security. What has changed since that time other than the disaster of 9-11? Nothing other than the President of the United States and the Secretary of Defense. By allowing the Secretary to modify and replace the provision under 5 U.S.C. 7101-7135, you are allowing him the remove the rights of DoD employees to participate in a labor organization if they choose. Make a stand and do not allow the Secretary to remove these rights which many citizens fought and died for so many years ago.
