SUBPART H: APPEALS. Section 9901.807 (k)(2): DOD has provided no reason as to the necessity for the proposal that either party may file a motion to disqualify a party’s representative during appellate proceedings. This is highly unusual and no standard has been provided as to when such a motion should be approved. Unless there is some conflict of interest argument which can be described, this provision is unnecessary, highly objectionable, and should be deleted.
